15. Liability for delays and damage to baggage

Liability for delays

In the event of the delay of the Passenger, FlyValan will be liable for any damages sustained providing that all reasonable measures were not taken to avoid the damage or if it was impossible for it to take such measures, up to the limit of 4,694 Special Drawing Rights.

Liability for damage to baggage

In the event of loss or damages to baggage, the rules to this respect deriving from international and national legislation in force will be applied, in particular the Air Navigation Law of 1960 and the Montreal Convention, as well as Regulation (EC) 2027/97.

FlyValan will be liable, in the event of the destruction, loss, delay or damage to baggage, up to the quantity of 1,131 Special Drawing Rights.

Notwithstanding the foregoing, if the Passenger made a special declaration of baggage value, he may have recourse to a higher limit of liability by making a special declaration.

With respect to checked baggage, the Carrier will in all cases be liable, but will only be liable for damages to cabin baggage caused by its fault or negligence.

If the checked baggage has been damaged, delayed, lost or destroyed, the Passenger should indicate this in writing to FlyValan as soon as possible and, in all cases, within 7 days in the event of damage and 21 days in the event of loss as of the placement of baggage at his disposal.
